Emigration Guru Pty Ltd (ABN [insert ABN]) (“Emigration Guru”, “we”, “us”, “our”) operates the website www.emigrationguru.com and related services (the “Platform”).
These Terms and Conditions (“Terms”) govern your access to and use of the Platform. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.
These Terms apply to all users of the Platform, including:
- Migrants (“Seekers”) — individuals searching for immigration agents and services
- Immigration Agents and Lawyers (“Agents”) — licensed immigration professionals who list their services on the Platform
- Visitors — anyone who browses the Platform without registering an account
Additional terms may apply to Agents through the Agent Agreement, which is incorporated by reference into these Terms.
1. About the Platform
1.1 What Emigration Guru is
Emigration Guru is an online marketplace and directory that connects migrants with verified, licensed immigration agents and lawyers. The Platform enables Migrants to search, compare, review, and book consultations with Agents. The Platform also provides educational content, including blog articles and guides about immigration topics.
1.2 What Emigration Guru is NOT
Emigration Guru is not a law firm, immigration consultancy, or migration agency. We do not provide immigration advice, legal advice, or immigration services of any kind.
- We do not recommend, endorse, or guarantee any particular Agent listed on the Platform.
- We do not verify the accuracy or quality of the advice or services provided by Agents.
- We do not act as your agent, representative, or lawyer.
- We are not a party to any agreement between a Migrant and an Agent.
- We do not guarantee any immigration outcome (visa approval, residency, citizenship, or any other result).
The relationship between a Migrant and an Agent is an independent professional relationship. Emigration Guru facilitates the connection — nothing more.
1.3 Not legal or immigration advice
All content on the Platform — including blog posts, guides, visa information, processing times, fees, and any other informational material — is provided for general information purposes only and does not constitute legal advice, immigration advice, or professional advice of any kind.
Immigration laws and policies change frequently. While we make reasonable efforts to keep our content accurate and up to date, we do not warrant the accuracy, completeness, or currency of any information on the Platform.
You should always seek independent professional advice from a qualified immigration agent or lawyer before making any immigration-related decisions. Reliance on any information provided on the Platform is at your own risk.
2. Eligibility and Account Registration
2.1 Eligibility
To use the Platform, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Provide accurate, current, and complete registration information
- Not have been previously suspended or removed from the Platform
2.2 Account registration
To access certain features (booking consultations, leaving reviews, listing agent services), you must create an account. When registering, you agree to:
- Provide truthful, accurate, and complete information
- Keep your registration information up to date
- Keep your password confidential and not share your account credentials with any other person
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorised use of your account
We reserve the right to suspend or terminate any account if we reasonably believe the information provided is inaccurate, incomplete, or fraudulent.
2.3 Account types
- Migrant accounts: For individuals seeking immigration services. Free to create.
- Agent accounts: For licensed immigration agents and lawyers. Subject to verification (see Section 3) and the Agent Agreement. Subscription fees may apply.
3. Agent Verification and Listing
3.1 Verification process
Agents who register on the Platform must submit their professional credentials for verification, including their MARA registration number (Australia), CICC licence number (Canada), or equivalent regulatory registration for their jurisdiction. We verify these credentials against publicly available government registers.
Verification confirms that the Agent holds a current registration or licence with the relevant regulatory body at the time of verification. It does not constitute an endorsement, recommendation, or guarantee of the Agent’s competence, quality of service, or suitability for any particular matter.
Verification does NOT include: – Criminal background checks or police clearances – Assessment of professional competence, skill level, or track record – Verification of claims made in the Agent’s profile (e.g., years of experience, success rates, specialisations) – Checking for pending complaints or disciplinary proceedings with the Agent’s regulatory body – Verification of professional indemnity insurance coverage
We conduct periodic re-verification of registration status, but we cannot guarantee that an Agent’s registration or licence status has not changed since their last verification. You are responsible for independently satisfying yourself as to the credentials and suitability of any Agent before engaging their services.
3.2 Agent responsibilities
Agents listed on the Platform agree to:
- Maintain a current and valid registration or licence with the relevant regulatory body (MARA, CICC, or applicable bar association) at all times
- Notify us immediately if their registration or licence is suspended, cancelled, or subject to conditions
- Ensure all information in their profile (including qualifications, specialisations, pricing, and availability) is accurate, current, and not misleading
- Comply with all applicable professional conduct rules, codes of ethics, and regulatory requirements
- Comply with all applicable advertising rules set by their regulatory body
- Provide professional services in accordance with the standard of care expected of a reasonably competent practitioner in their field
- Not engage in any conduct on the Platform that is unlawful, fraudulent, deceptive, or misleading
3.3 Agent profile content
Agents are solely responsible for the content of their profiles, including text, images, pricing, and service descriptions. We do not review, approve, or endorse the content of Agent profiles (beyond initial verification of registration status).
Agent profile content must not:
- Be false, misleading, or deceptive
- Violate any law or regulation, including consumer protection laws and professional advertising rules
- Infringe the intellectual property rights of any third party
- Contain offensive, discriminatory, or inappropriate material
- Guarantee any specific immigration outcome
We reserve the right to remove or modify any profile content that violates these Terms or that we reasonably consider inappropriate.
4. Bookings and Payments
4.1 Booking consultations
Migrants may book consultations with Agents through the Platform. By booking a consultation, you are entering into a direct agreement with the Agent — not with Emigration Guru.
The booking process is as follows:
- Migrant selects an Agent and consultation type
- Migrant chooses an available date and time
- Migrant provides a brief description of their needs
- Migrant reviews the booking summary (including the Agent’s consultation fee)
- Migrant completes payment through Stripe
- Both parties receive a booking confirmation
4.2 Fees and payment
- Consultation fees are set by each Agent independently. Emigration Guru does not control, set, or approve Agent fees.
- All payments are processed through Stripe. Emigration Guru does not store your credit card information.
- Prices displayed on the Platform are in the Agent’s nominated currency (typically AUD or CAD) and are inclusive of the Agent’s fee and the Platform’s service fee.
- The Platform charges a service commission on each booking, which is deducted from the Agent’s payout. The commission rate is determined by the Agent’s subscription tier.
- Agents receive payouts after the consultation is completed, minus the Platform commission, in accordance with the payout schedule outlined in the Agent Agreement.
4.3 Cancellation and refunds

Refunds are processed through the original payment method (Stripe) and may take 5-10 business days to appear in your account.
4.4 Disputes
If a Migrant is dissatisfied with a consultation, they may raise a dispute within 48 hours of the consultation. Emigration Guru will review the dispute and may, at its sole discretion:
- Issue a full or partial refund to the Migrant
- Request further information from either party
- Decline the dispute if the Agent reasonably delivered the booked service
During a dispute, Emigration Guru may hold the relevant consultation fee pending resolution. If a dispute is resolved in the Migrant’s favour, the held amount (or the relevant portion) will be refunded. If resolved in the Agent’s favour, the held amount will be released to the Agent.
Emigration Guru’s dispute resolution is limited to payment disputes related to whether the booked consultation was delivered. We do not adjudicate the quality of immigration advice provided, the correctness of legal opinions, or the outcome of any immigration matter. Complaints about the quality of professional services should be directed to the Agent’s regulatory body (MARA, CICC, or applicable authority).
5. Reviews and User Content
5.1 Reviews
Migrants who have completed a booked consultation may submit a review and rating for the Agent. Reviews must:
- Be based on your genuine experience with the Agent
- Be truthful, accurate, and not misleading
- Not contain personal information of any individual (including full names of third parties, phone numbers, email addresses, or case-specific details that could identify others)
- Not contain profanity, hate speech, discriminatory language, or threats
- Not contain spam, advertising, or promotional content
- Not be submitted in exchange for compensation or incentives from any party
- Not be fake, fabricated, or submitted by someone who did not receive the service
Submitting fake or misleading reviews may constitute a breach of the Australian Consumer Law and may be investigated by the Australian Competition and Consumer Commission (ACCC). We take the integrity of reviews seriously and reserve the right to report suspected fraudulent review activity to the relevant authorities.
Agents may respond to reviews publicly (one response per review).
We reserve the right to remove reviews that violate these guidelines. Agents may flag reviews for our review, but we do not remove reviews simply because an Agent disagrees with the content.
Reviews reflect the personal opinions of the individual reviewer. Emigration Guru does not verify, endorse, or adopt the views expressed in any review.
5.2 Other user content
Any content you submit to the Platform — including reviews, messages, forum posts (when available), and profile information — (“User Content”) remains your intellectual property. However, by submitting User Content, you grant Emigration Guru a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Platform.
You represent and warrant that:
- You own or have the necessary rights to submit the User Content
- The User Content does not infringe the intellectual property rights of any third party
- The User Content does not violate any law or regulation
We reserve the right to remove any User Content that violates these Terms, without prior notice.
6. Acceptable Use
You agree not to use the Platform to:
- Violate any applicable law, regulation, or third-party right
- Provide false, misleading, or fraudulent information
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Harvest, collect, or store personal information of other users
- Send unsolicited communications (spam) to other users
- Interfere with or disrupt the Platform’s infrastructure, security, or functionality
- Attempt to gain unauthorised access to any part of the Platform, other user accounts, or systems
- Use automated tools (bots, scrapers, crawlers) to access the Platform without our written consent
- Upload or transmit viruses, malware, or any harmful code
- Circumvent or attempt to circumvent the Platform’s payment system (e.g., by arranging direct payment outside the Platform for services initially facilitated through the Platform)
- Use the Platform for any purpose that is unrelated to immigration services or the intended use of the Platform
- Post or transmit content that is defamatory, obscene, discriminatory, threatening, or otherwise objectionable
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including suspending or terminating accounts and reporting conduct to law enforcement authorities.
7. Intellectual Property
7.1 Emigration Guru’s intellectual property
The Platform and its entire contents — including but not limited to text, graphics, logos, icons, images, software, code, design, layout, and data compilations — are the property of Emigration Guru Pty Ltd or its licensors and are protected by Australian and international copyright, trademark, and other intellectual property laws.
The Emigration Guru name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Emigration Guru Pty Ltd. You may not use these marks without our prior written permission.
7.2 Limited licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial use in accordance with these Terms. This licence does not include:
- Any resale or commercial use of the Platform or its contents
- Any derivative use of the Platform or its contents
- Downloading, copying, or reproducing any part of the Platform for commercial purposes
- Using data mining, robots, or similar data gathering tools on the Platform
7.3 Blog and informational content
Blog posts, guides, and other informational content published on the Platform are protected by copyright. You may share links to our content and quote brief excerpts with attribution, but you may not reproduce, republish, or redistribute our content in full without our prior written consent.
8. Disclaimer of Warranties
To the maximum extent permitted by law:
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. EMIGRATION GURU MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING:
- The availability, reliability, or uninterrupted operation of the Platform
- The accuracy, completeness, or currency of any information, content, or data on the Platform (including blog posts, visa information, processing times, and fee schedules)
- The quality, competence, suitability, or conduct of any Agent listed on the Platform
- The outcome of any immigration application, visa process, or legal matter
- The accuracy of any review or rating submitted by users
- The security of data transmitted through the Platform (notwithstanding our security measures described in the Privacy Policy)
In particular, Emigration Guru does not warrant or guarantee that:
- Any Agent listed on the Platform is suitable for your particular needs
- Any information provided by an Agent is accurate, complete, or constitutes competent legal or immigration advice
- Any visa application or immigration matter will result in a favourable outcome
- The Platform will meet your specific requirements or expectations
You acknowledge that:
- You are responsible for independently evaluating any Agent before engaging their services
- The decision to engage an Agent and the terms of that engagement are solely between you and the Agent
- Emigration Guru is not a party to and has no liability in respect of any agreement between a Migrant and an Agent
Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, term, or condition implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
9.1 Exclusion of liability
Emigration Guru, its directors, officers, employees, agents, and affiliates shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, goodwill, or anticipated savings
- Loss or damage arising from or in connection with:
- The conduct, acts, omissions, advice, or services of any Agent listed on the Platform
- Any immigration decision, visa refusal, application delay, or other immigration outcome
- Any reliance on information or content on the Platform (including blog posts, guides, and user reviews)
- Any dispute between a Migrant and an Agent
- Any unauthorised access to or alteration of your data
- Any interruption, suspension, or termination of the Platform
- Any third-party conduct on or connected to the Platform
9.2 Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict, or modify rights that you may have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement. If the Australian Consumer Law applies to you, our liability for a failure to comply with a consumer guarantee is limited (to the extent permitted by law) to:
- For goods: The replacement or repair of the goods, or the cost of replacement or repair
- For services: The supply of the services again, or the payment of the cost of having the services supplied again
9.3 Indemnification
You agree to indemnify, defend, and hold harmless Emigration Guru, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any law or regulation
- Any User Content you submit
- Any dispute between you and an Agent (where you are a Migrant) or between you and a Migrant (where you are an Agent)
- Any claim that your User Content infringes the intellectual property rights of a third party
10. Third-Party Services and Links
The Platform may contain links to third-party websites, services, or content that are not owned or controlled by Emigration Guru, including government immigration websites, language testing providers, payment processors, and social media platforms.
We are not responsible for the content, privacy policies, practices, availability, or accuracy of any third-party websites or services. Inclusion of a link does not imply endorsement.
Your use of third-party services is at your own risk and subject to those third parties’ terms and conditions.
11. Suspension and Termination
11.1 By you
You may close your account at any time by contacting us at support@emigrationguru.com or through your account settings. Closing your account does not automatically cancel any active bookings — you must cancel those separately.
If you are an Agent, account closure is subject to the terms of the Agent Agreement, including any notice period and outstanding obligations (e.g., pending bookings, payouts).
11.2 By us
We may suspend or terminate your account, or restrict your access to the Platform, at any time and for any reason, including but not limited to:
- Violation of these Terms or the Agent Agreement
- Fraudulent, deceptive, or unlawful conduct
- Conduct that is harmful to other users, Agents, or the Platform
- Extended inactivity (accounts inactive for 24+ months may be deactivated)
- Failure to maintain valid professional registration (Agents)
- At the request of a regulatory body or law enforcement agency
- For any other reason at our sole discretion, with reasonable notice where practicable
If we terminate your account for a violation of these Terms, you may not create a new account without our written permission.
11.3 Effect of termination
Upon termination:
- Your right to access and use the Platform ceases immediately
- Any outstanding bookings may be cancelled (with refunds processed where applicable)
- Agent payouts for completed consultations will still be processed in accordance with the Agent Agreement
- Published reviews will remain on the Platform unless they violate our guidelines
- We may retain your personal information as described in our Privacy Policy (data retention obligations)
Sections of these Terms that by their nature should survive termination will survive, including but not limited to: Disclaimer of Warranties (Section 8), Limitation of Liability (Section 9), Indemnification (Section 9.4), Governing Law (Section 14), and Dispute Resolution (Section 15).
12. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is available at www.emigrationguru.com/privacy-policy and is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your personal information.
13. Modifications to the Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the “Last updated” date at the top of this page
- Notify registered users by email at least 14 days before the changes take effect
- Display a prominent notice on the Platform
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Platform and close your account.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia, and you irrevocably submit to the jurisdiction of those courts.
Nothing in this section limits Emigration Guru’s right to seek injunctive or other equitable relief in any court of competent jurisdiction.
15. Dispute Resolution
15.1 Informal resolution
Before commencing any formal legal proceedings, you agree to first contact us at legal@emigrationguru.com and attempt to resolve any dispute informally. We will make reasonable efforts to resolve your concern within 30 days.
15.2 Mediation
If a dispute cannot be resolved informally within 30 days, either party may refer the dispute to mediation administered by the Australian Disputes Centre (ADC) or another mutually agreed mediation provider. Mediation will be conducted in Sydney, New South Wales, or by video conference. The costs of mediation will be shared equally between the parties.
15.3 Litigation
If mediation does not resolve the dispute within 60 days, either party may commence court proceedings in accordance with Section 14 (Governing Law and Jurisdiction).
15.4 Exceptions
Nothing in this section prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
16. General Provisions
16.1 Entire agreement
These Terms, together with the Privacy Policy and (for Agents) the Agent Agreement, constitute the entire agreement between you and Emigration Guru regarding your use of the Platform. They supersede all prior agreements, communications, and understandings, whether written or oral.
16.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of Emigration Guru.
16.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Emigration Guru may assign its rights and obligations under these Terms to a successor entity in connection with a merger, acquisition, or sale of assets.
16.5 Force majeure
Emigration Guru shall not be liable for any failure or delay in performing its obligations under these Terms caused by events beyond its reasonable control, including but not limited to natural disasters, acts of government, internet outages, power failures, pandemics, strikes, or civil unrest.
16.6 Notices
All notices under these Terms will be sent:
- To you: By email to the address associated with your account, or by posting a notice on the Platform
- To us: By email to legal@emigrationguru.com, or by mail to Emigration Guru Pty Ltd, [Insert Address], Australia
Notices sent by email are deemed received on the day they are sent (unless the sender receives a delivery failure notice).
16.7 Relationship of the parties
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Emigration Guru. Agents are independent professionals — not employees, contractors, or agents of Emigration Guru.
